Hi Adam – The first thing that your Dad needs to do is get permission from the cemetery. In NY – the cemetery has 1st right of refusal. If they do not buy them back, they must issue you a release allowing you to sell on your own. But you must have that release first – otherwise the actual owner of the plots will still be the cemetery.
